Developer Robert Mericle's testimony won't be needed at former state Senator Ray Musto's public corruption trial because Musto has been declared mentally incompetent to stand trial at this time. Mericle was scheduled to be a prosecution witness. That clears the way for Mericle to be sentenced relative to his part in the Luzerne County Kids for Cash scandal. He admitted in September of 2009 that he did not report a felony. He paid then-judges Mark Ciavarella and Michael Conahan a total of 2.1-million dollars. The judges sent juvenile offenders to private juvenile detention centers built by Mericle. His sentencing date is set for the 26th of next month. Mericle was not charged in the Musto case.
